Regulating AI by Purpose, Not Prohibition

The real AI policy question isn’t whether to regulate, it’s what it should achieve.

A new framing from Georgetown's Center for Security and Emerging Technology suggests the debate should pivot from a blanket yes or no on AI regulation to a sharper question: what is innovation for, and who benefits from it? In an opinion piece published in Newsweek, Matthias Oschinski and Mina Narayanan argue that the core tension in governance is not innovation versus restriction but innovation guided by purpose versus innovation driven by default incentives. Policy documents show that this pivot matters because it pushes regulation from being a blunt throttle to a targeted instrument that aligns AI development with public goods.

The authors urge regulators to stop treating regulation as a barrier the moment a new capability appears and start treating it as a mechanism to steer outcomes. The idea is simple but consequential: evaluate AI systems by the ends they serve and the harms they could cause, then design lightweight rules that ensure safety, accountability, and fairness without choking beneficial innovation. The op-ed anchors this shift in the claim that the real debate is about shaping incentives, namely whether designers and deployers are nudged toward the public interest or left to default profit and performance pressures. In that sense, governance becomes less about policing the code and more about shaping how and why AI is put to use.

For compliance professionals and policy makers, the framing has practical implications. If regulation is reframed as purpose driven, then risk assessment moves from a category of tools to a category of outcomes. Regulators would focus on use cases with meaningful public impact, such as healthcare, finance, or critical infrastructure, and require that deployments demonstrate verifiable benefits aligned with broader societal goals. The op-ed implies a governance model that privileges transparency about use cases, the beneficiaries of AI deployments, and the metrics by which success is judged, rather than just technical safety features in isolation.

Two concrete practitioner insights emerge from this perspective. First, the tradeoff between speed and safety becomes a function of purpose. When the objective is high societal value and low potential for harm, lighter touch governance may be appropriate, provided there is robust post-deployment monitoring and independent audits. When the use case carries significant risk to people or markets, stronger governance and more rigorous oversight are warranted. Second, incentives matter as much as rules. If the default incentives in commercial AI development reward speed and scale over careful testing and impact assessment, regulation must create countervailing incentives, such as public-interest disclosures, third-party validation, or performance dashboards that reveal real-world effects. The result is not stricter rules for their own sake, but a regulatory design that makes responsible deployment the path of least resistance.

The argument also foreshadows a need for governance institutions that can adapt as technology evolves. If what matters is purpose and outcomes, regulators must be able to update criteria as new capabilities emerge, and industry must be prepared to demonstrate ongoing alignment with those criteria. This implies a credible framework for accountability, not a one-off compliance checklist. It also means that global cooperation matters, because AI deployment crosses borders quickly and the public can be affected far from the engine room where the models are trained.

In the end, the op-ed from Oschinski and Narayanan reframes the entire design problem. Regulation is not merely a set of prohibitions; it is a map of intended benefits and the pathways to avoid harm. For policymakers, it’s a reminder that the value of AI lies not in novelty alone, but in the edge cases where public outcomes matter most. For industry, it’s a nudge toward building governance into the product from day one, and for workers and everyday users, it’s a promise that the trend toward smarter systems comes with clearer accountability and a clearer sense of purpose.
