Regulators just stopped asking if AI should be regulated—now they're asking what it's for.

An op-ed published by Newsweek, written by Matthias Oschinski and Mina Narayanan of the Center for Security and Emerging Technology, argues that the central policy question should be purpose, not prohibition or permissiveness. The authors contend the real debate isn’t innovation versus regulation; it’s innovation guided by purpose versus innovation left to default incentives. In plain terms: governance should steer AI toward broadly beneficial ends, not merely impose rules in the abstract.

The shift matters because it reframes how rules are designed, tested, and enforced. If regulation is tied to concrete societal aims—safety, fairness, privacy, accountability—policymakers can move beyond tick-box compliance toward outcomes that matter in people’s daily lives. Policy documents show a growing interest in aligning AI outcomes with public welfare, rather than treating all AI use as equally risky or worthy of the same controls. The ruling specifies that governance should be purposive: determine what we want AI to achieve, then build the rules that reliably steer toward those goals.

Industry observers will watch closely how this framing translates into practice. For regulators, the logic suggests a move away from universal mandates toward use-case‑specific standards, risk assessments, and verification regimes tied to clearly defined outcomes. For companies, the implication is a demand for stronger governance studios inside product labs: not just showing what the system does, but proving why a given application serves a defined societal objective and how risks will be mitigated. The result could be a more nuanced, but potentially more demanding, regulatory posture—one that asks teams to articulate purpose at the design stage and to prove it as part of ongoing compliance.

Practitioner insights follow naturally from the framing:

  • Define the “why” before the “what.” Compliance teams should require a crisp statement of intended societal purpose for high-stakes AI uses, followed by measurable indicators of success and risk controls. This helps avoid broad, vague mandates that can be gamed or ignored.
  • Align incentives with purpose, not only performance. Procurement and funding mechanisms can reward demonstrated alignment with public aims—such as privacy-by-design, fairness checks, or safety safeguards—so the default incentives drive responsible innovation rather than speed alone.
  • Build in robust verification. If outcomes become the yardstick, independent audits, transparent reporting, and reproducible assessments become essential. Expect audits to cover not just safety but the integrity of the purpose claims themselves and the real-world impact on users.
  • Harmonize across borders to prevent regulatory arbitrage. A purpose-driven approach gains strength when similar societal aims and verification standards are recognized internationally; otherwise, firms may relocate activities to the least burdensome jurisdiction, undermining protection and trust.
  • For regular people, the reframing promises clearer protections without freezing innovation. When AI systems are judged by tangible outcomes—privacy preservation, non-discrimination, safety guarantees—everyday interactions with technology could become safer and more predictable. But there’s a caveat: if the “purpose” tests are inconsistently defined or inconsistently applied, rules risk becoming a patchwork that creates confusion and slows beneficial deployment.

    Overall, the piece argues for governance that does more than police behavior; it steers technological development toward shared values. If policymakers ask what AI is for and design rules around that purpose, compliance becomes a continuous, verifiable journey—one that could reduce the chilling effects of over-broad regulation while preserving room for meaningful innovation.
