Rethinking AI Regulation: Regulate for Purpose

The real debate isn't whether to regulate AI—it's what we’re regulating it for.

Two Center for Security and Emerging Technology analysts argue that the governance question should pivot from “to regulate or not” to “what outcomes are we driving with regulation.” In a Newsweek op-ed, Matthias Oschinski and Mina Narayanan reject the common dichotomy of innovation versus regulation. Policy documents show the more productive debate is about innovation guided by purpose versus innovation left to default incentives. In other words: regulation isn’t a blunt instrument—it’s a design choice intended to align AI development with publicly valued ends.

The piece reframes regulation as governance design rather than a set of hard bans. Rather than prescriptive rules aimed at limiting capability, the authors suggest rules that shape incentives toward safety, accountability, and societal benefit. The key argument: the objective of AI policy should be clear outcomes—reduce harms, protect privacy, ensure fairness, and promote trustworthy deployment—while leaving room for beneficial innovation to flourish. It’s a call to move beyond the binary question of “should regulation exist?” toward “how should regulation steer technology toward worthwhile ends?”

For practitioners in compliance and policy, the shift in framing carries concrete implications. First, it pushes for purpose-driven standards rather than checkbox compliance. Compliance guidance would focus on documenting intended use, risk framing, and measurable safety outcomes tied to specific use cases. This means risk assessments that connect business goals to demonstrable safeguards, not generic “avoid danger” memos. Second, the governance approach invites a layered, incentive-based regime: transparent disclosure for high-risk applications, independent audits of data quality and model behavior, and accountability mechanisms that trace responsibility when things go wrong. In short, regulation should create predictable incentives for responsible product design, not chase every edge case with one-size-fits-all rules.

From an industry vantage, the op-ed highlights the danger of regulatory arbitrage—the risk that firms relocate to jurisdictions with looser rules simply to accelerate deployment. International coordination becomes more than a courtesy; it’s a practical necessity to establish common goalposts and shared accountability. This is especially salient for sectors like healthcare, finance, and public safety, where the societal stakes are high and the costs of misalignment are visible to policymakers and the public alike.

For workers and everyday users, the argument translates into tangible expectations: governance should ensure AI systems do not amplify biases, preserve meaningful human oversight where needed, and deliver redress pathways when harms occur. The emphasis on purpose helps steer regulatory attention toward real-world impacts—who benefits, who bears risk, and how those outcomes are measured and corrected over time.

As the op-ed underscores, the governance project is not about stifling innovation but about shaping it with intent. The authors place governance design at the center of policy conversations, inviting regulators, companies, and civil society to articulate clearly what AI should achieve and how to measure progress. In a field notorious for shifting capabilities and vague promises, that clarity—paired with robust, enforceable incentives—could be the difference between AI that serves the common good and technology that outpaces our capacity to control it.
