Age standard change could push universal age checks

Last week the House passed the KIDS Act, setting up a shift toward universal age verification online.

The core idea driving the filing is a change to the legal standard for what an online service must know about a user’s age before the law’s obligations kick in. The bills package, which includes a revised Kids Online Safety Act and COPPA 2.0, is not just about data minimization or turning off engagement features. It quietly pivots the risk calculus for every platform that touches young users by lowering the threshold of what operators must know about a user’s age. The consequence, as the advocacy group behind the argument frames it, is a powerful incentive to verify age for nearly every reader, commenter, viewer, and shopper who visits a site.

For compliance officers and platform leaders, the practical implication is a re orientation of identity and age verification workflows. The filing states that lowering the standard would push operators toward age verification of all users, adult and child alike, even in contexts where the user may not disclose age explicitly. That would affect a wide swath of the internet, from social networks to streaming services to online marketplaces, changing not only what data is collected but how it is used to grant access, tailor content, and determine what features remain available.

In the current legal design, companies have built their privacy and safety controls around the marginal case of a user who misrepresents age or is difficult to verify. The proposed approach flips that around. If enacted, operators would face a regime where the default expectation is to confirm age before certain obligations apply and before content or features are accessible. The broader intent is clear to privacy advocates: reduce the risk that a platform serves a young audience without knowing who is actually engaging. Critics, however, warn that such a design can create a web where the default state is you must prove who you are just to read, post, or browse.

What this means for risk, budgets, and timelines is not abstract. Compliance teams should prepare for workflows that incorporate age checks at or before user signup, and in some cases for ongoing verification to maintain access rules. The shift would carry tradeoffs between user experience and safety, with higher verification costs for platforms and potential pushback from users who value seamless access. From an engineering standpoint, the move would require robust identity verification methods, processes to protect collected age data, and clear retention rules to minimize data after verification is complete. It also raises questions about spoofing, accuracy, and what happens when a user’s age changes.

Two clear signals to watch: first, how the legislative process unfolds on these provisions and whether the bills land with any deadlines or phased rulemaking. The filing points to a future stage where compliance deadlines and enforcement mechanisms would be clarified through rulemaking and agency guidance if the bills advance. Second, jurisdictions and platforms will monitor how the standard is interpreted in practice, testing the durability of universal age checks against false positives, accessibility concerns, and the friction costs borne by everyday users.

The debate underscores a broader policy challenge: how to balance child protection with a usable, open web. If the proposed standard takes hold, the next few years will be about turning a bold principle into concrete, testable rules that companies can operationalize without breaking the user experience for the majority of legitimate adult customers.
